EU Data Act Information
Regulation (EU) 2023/2854 (the EU Data Act) gives users of connected products certain rights to access data generated by the use of those products.
PhoneWatch provides connected alarm systems and related monitoring services that may generate data during normal use. For the purposes of the Data Act, PhoneWatch may act as a data holder in relation to such data.
What data is covered
Depending on the product and configuration, data generated may include information about the operation and status of the alarm system, alarm events, and technical or diagnostic data necessary for the functioning and security of the system. In some cases, images or video may be generated in connection with verified alarm events.
The volume of data generated may vary depending on how the connected products are used. Data is generated in a structured, commonly used and exportable format.
Connected products generate and transmit data when they are active and connected. Depending on the product configuration, certain data may also be synchronised automatically at periodic intervals.
Your rights under the Data Act
In accordance with the Data Act, you may request access to data generated by your use of PhoneWatch's connected products and services, subject to the conditions and limitations set out in the regulation. Upon request, relevant data will be made available in a structured, commonly used and machine-readable format, free of charge and without undue delay, where required by law.
Data generated by connected products may already be made available to customers through existing interfaces and communication channels, for example via a mobile application displaying system status and event logs, notifications relating to relevant events, or communication with our alarm monitoring centre in connection with critical incidents.
You may also request that data be made available to a third party designated by you, in accordance with applicable legal requirements.

Relationship with data protection law
Where the data constitutes personal data, the General Data Protection Regulation (GDPR) applies. In case of conflict, applicable data protection legislation takes precedence. Data is retained only for as long as necessary for the provision of the contracted services, maintenance and security of the system, and compliance with applicable legal obligations.
